Collaborative Divorce.
Increasingly, people are seeking less expensive and more effective out-of-court divorce solutions better tailored to their lives and future goals. They recognize that the traditional litigation model of divorce does not suit all situations. Fortunately, divorcing couples now have an alternative process, known as collaborative law, through which they can retain control over their futures while also avoiding legal confrontations at the courthouse.
In Collaborative Divorce, the parties and their attorneys commit, in writing, not to litigate their dispute but to negotiate together in good faith to reach a durable resolution. What is a durable resolution? It is one that will stand through the remainder of the parties’ lives and interactions with each other, whether involving children and parenting, retirement planning, division of assets and debts or financial support. Research shows that collaboratively reached agreements seldom result in future disputes and litigation.
In Collaborative Divorce, the parties control all facets of the outcome of their divorce instead of turning the decision-making over to a judge. Mediation.
Marie also refers clients to mediation as a process to assist parties who may already be in litigation to avoid more court action. She can provide the guidance needed for clients to make informed choices throughout the mediation process and draft final settlement documents.
Litigation.
Occasionally, neither collaborative law nor mediation is an appropriate choice for divorce resolutions. Unique facts or extreme animosity and hostility may make either choice inappropriate. In these cases, Marie is a skillful advocate and aggressive litigator.
